The Address Problem of Civil Society: Obstacles to Freedom of Association Evaluated

Our note examining the practices regarding the location of associations in terms of freedom of association has been published. The study prepared by Assoc. Prof. Dr. Ulaş Karan analyzes the restrictive effects of administrative practices concerning the locations of associations on the freedom of association.

In the study, the administrative opinion that limits the activities of multiple associations at the same address and the requirement of "unanimous consent of apartment owners" for opening association headquarters in residences were analyzed from the perspective of freedom of association. 

The note emphasized that administrative measures would be sufficient to solve these problems without the need for legal amendments. In this context, it was recommended to change the approach towards the ban on activities at the same address and to abolish the circular introducing the unanimity requirement.

The study also included recommendations for allowing associations to operate digitally and to use virtual offices, stating that such measures could reduce costs and strengthen civil society’s work for the public good. The recently introduced e-notification system was evaluated as a positive step in this direction.
