Why the ÖTV (Special Consumption Tax) Exemption Law Proposals for the Deaf and Hearing Impaired People are not accepted?

In our country, deaf and hearing impaired individuals who have difficulty in hearing the manual gear and have difficulty in buying more expensive automatic transmission vehicles, want to enjoy of ÖTV exemption right like orthopedically handicapped individuals for the purchase of automobiles.

CSOs have expressed the demands on above mentioned issue to policy makers as well as carrying out campaigns and lobbying activities in this respect. Besides, these demands were found voice in the general assembly of the TGNA.As a result of these efforts, several legislation proposals have been initiated that can be seen the details of proposals at the below link of Turkish Grand National Assembly. But mentioned legislation proposals have not been adopted. However, individuals under the age of 18 who have ÖKGV (Special Conditions Requirement) clause with ÇÖZGER (Special Needs Assessment for Children) report, have been granted the ÖTV exemption with the by-law on ÇÖZGER in official gazette dated on20 February 2019 and numbered with 30692. In other words, along with discrimination on “type of disability”, the “age-based” discrimination has also started to be applied by the legislation. "Equality” principle in the constitution of Republic of Turkey was damaged once more.

We leave denial of below legislation proposals with the same contents to the discretion of the hearing-impaired individuals who are right claimants and the general public. Finally, we want the law proposal, submitted by CHP Samsun Deputy Mrs. Neslihan HANCIOĞLU on 2 March 2021 to be adopted.

With the ÖKGV (Special Conditions Requirement) clause in ÇÖZGER report in 2019, ÖTV exemption was started to be granted to hearing-impaired individuals with aged 18 and under.
